These Terms govern your use of your drop box, and the rest of this web site. Using the InternetDropBox constitutes your acceptance of these Terms, and creates a binding legal agreement.

All material on this web site is protected by copyright and in some cases are trademarks. All trademarks and images are the property of their owners and you may not duplicate or distribute them in any way, without the express written permission of the owner(s) of the material.

You certify that any materials which you place in your Drop Box are owned by you, and/or that you have the legal right to place these materials into your Drop Box. The Photo Lab and provider of your Drop Box assumes no responsibility for any of the material placed in your Drop Box or for any damages which may result from this action. You agree to indemnify and hold harmless the Photo Lab for any damages which may arise from the material placed in your Drop Box, or from the release of this material, regardless of how that release occurred.

 

Content

The Photo Lab does not monitor the content of the materials placed in your Drop Box. You agree that you shall not place any unsuitable content in your Drop Box. Unsuitable content includes, but is not limited to, any material which unlawful, obscene, dangerous, threatening, harassing, hateful or in any other way objectionable. You agree that you shall not place any content in your Drop Box that you do not have a legal right copy or distribute.

You agree that you shall not place any obscene or pornographic materials, including but not limited to child abuse or child pornography, into your Drop Box.

 

DISCLAIMER OF LIABILITY

NEITHER THE PHOTO LAB NOR THE MANUFACTURER OF THIS SOFTWARE OR EQUIPMENT SHALL IN ANY WAY BE LIABLE FOR THE PROTECTION OR SECURITY OF ANY MATERIAL PLACED INTO YOUR DROP BOX. THE PHOTO LAB DOES NOT IN ANY WAY GUARANTEE THE STORAGE OR SECURITY OF THE MATERIALS IN YOUR DROP BOX. NEITHER THE PHOTO LAB NOR THE MANUFACTURER OF THIS SOFTWARE OR EQUIPMENT SHALL BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL, INCIDENTAL OR PUNATIVE DAMAGES ARISING FROM THE LOSS OR RELEASE, OF ANY MATERIALS PLACED IN YOUR DROP BOX.

 

Governing Law

The validity and interpretation of this Agreement shall be governed by the laws of the State of California without giving effect to the principles of conflict of laws, with venue for all purposes to be proper only in the County of Santa Barbara, California.

 

Severability

If any term, provision, covenant, or condition of this Agreement shall be or become illegal, null, void or against public policy, or shall be held by any court of competent jurisdiction to be illegal, null or void against public policy, the remaining provisions of this Agreement shall remain in full force and effect and shall not be effective, impaired or invalidated thereby.
